Canadesk (“Canadesk”, “XBPMN”, “we”, “us”, or “our”) provides AI-powered support applications designed to integrate with third-party platforms. This Privacy Policy explains how we collect, use, disclose, and protect personal information in connection with our services. By using our applications, you agree that Canadesk acts solely as a data processor on behalf of its clients, and that clients assume all responsibility for compliance with applicable privacy laws and user notices.
2. Information We Collect
We collect personal information only at the explicit direction of our clients:
- Requested User Data: Information provided by end users such as names, email addresses, and support tickets.
- Usage Data: Interaction logs, performance metrics, and error reports generated by our AI support agents.
- Technical Data: Device identifiers, IP addresses, browser type, and other technical metadata gathered automatically.
Clients represent and warrant that they have obtained all necessary consents to share this information with us.
3. How We Use Your Information
Our use of personal information is strictly limited to purposes instructed by our clients:
- To operate, maintain, and improve our applications.
- To respond to client-authorized inquiries and support requests.
- To analyze usage trends and improve service functionality.
- To comply with legal requirements under Canadian law.
We never use personal information for unrelated purposes such as marketing or profiling.
4. Data Sharing and Disclosure
All disclosures of personal information are made only at the direction of our clients:
- Integration Partners: We share data with Freshdesk, Zendesk, or other client-authorized platforms solely to enable service functionality.
- Service Providers: Third parties assisting in hosting, maintenance, or analytics, under written confidentiality obligations.
- Legal Requirements: When compelled by a valid Canadian court order or government request.
- Corporate Transactions: In the context of a merger, acquisition, or sale of assets, subject to confidentiality protections.
Canadesk disclaims any role as a data controller; clients retain full liability for lawful disclosure.
5. Data Retention
We retain personal information only as long as necessary to fulfill the purposes set out by our clients and in accordance with any applicable law, but in no event longer than 12 months following termination of service unless otherwise instructed in writing.
6. Your Rights
Clients remain responsible for notifying end users of their privacy rights. To the extent required by applicable Canadian law, users may have rights to access, correct, or delete their personal information. All requests should be directed to the client, not to Canadesk.
7. Security
Canadesk implements commercially reasonable technical and organizational measures to protect personal information. Clients are responsible for reviewing and enforcing any additional security requirements of integrated third parties such as Freshdesk or Zendesk. Canadesk assumes no liability for the security practices of any third party.
8. Third-Party Services
Our applications may link to or integrate with third-party services. We are not responsible for their privacy practices, security measures, or content. Clients should conduct their own due diligence and notify end users to review those third parties’ policies.
9. International Data Transfers
Personal information may be transferred to jurisdictions outside Canada for processing or storage. Clients consent to such transfers on their own behalf and on behalf of their end users.
10. Changes to This Privacy Policy
We may update this Privacy Policy periodically. The revised version will be posted here with an updated effective date. Clients are responsible for notifying their end users of any material changes.
11. Limitation of Liability
- Canadesk’s aggregate liability for any claim arising out of or related to this Privacy Policy is capped at the total fees paid by the client for the service in the 12 months preceding the claim.
- Canadesk is not liable for any indirect, incidental, special, or consequential damages.
- Clients agree to defend, indemnify, and hold harmless Canadesk for any damages, fines, or losses resulting from client or end-user noncompliance with applicable privacy laws.
12. Disclaimer
Canadesk provides its services “as is” without any warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement, to the fullest extent permitted by law.
13. Indemnification
Clients shall indemnify and hold Canadesk harmless from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of:
- Client’s failure to obtain valid consents or to comply with applicable privacy laws.
- Any breach of client’s representations or obligations under this Privacy Policy.
14. Governing Law
This Privacy Policy is governed by and construed in accordance with the laws of the Province of Québec, Canada. Any disputes shall be resolved exclusively in the courts located in Québec City, Québec.
By using our applications, you acknowledge that you have read, understood, and agreed to the terms of this Privacy Policy. If you do not agree, please do not use our services.
